When are Resident Reviews required?
Originally when the PASRR regulations were completed in 1992, Resident Reviews were required annually. The Balanced Budget Act of 1996 added Section 1919(e)(7)(B)(iii) to the Social Security Act, which eliminated the requirement for annual Resident Review.
Nursing facilities are required to notify the state mental health authority or state intellectual disability authority, as applicable, of the need for a Resident Review promptly after a significant change in the mental or physical condition of a resident who has, or is suspected of having, a mental illness, intellectual disability or related condition.
See FAQ “What is considered a significant change in condition?” for further clarification on what factors could lead to a nursing facility notifying the MH or ID authority.
